1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ZikQuote ("Company," "we," "us," or "our") governing your access to and use of our website, services, and platform (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the Service after any such modifications constitutes your acceptance of the modified Terms.

2. Description of Service

ZikQuote is a lead generation service that connects homeowners and property owners with verified roofing contractors and companies. We provide a platform where users can submit information to request quotes for roofing services, and we facilitate the connection between users and third-party roofing service providers.

Important: ZikQuote is not a roofing contractor, does not provide roofing services, and does not guarantee the quality, pricing, or availability of services provided by third-party contractors. We are a referral and lead generation service only.

3. User Eligibility and Account

To use our Service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Provide accurate, current, and complete information when using the Service
  • Maintain and promptly update your information to keep it accurate, current, and complete
  • Not use the Service for any illegal or unauthorized purpose

You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account.

4. User Conduct and Prohibited Activities

You agree not to:

  • Submit false, fraudulent, misleading, or inaccurate information
  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
  • Use automated systems, bots, or scripts to access or use the Service
  • Transmit any viruses, malware, or other harmful code
  • Collect or harvest any information about other users of the Service
  • Use the Service to spam, harass, or harm others
  • Reverse engineer, decompile, or disassemble any portion of the Service

5. Information Submission and Consent

When you submit information through our Service to request a quote (including by clicking any form submission button such as "View My Instant Estimate," "Get Estimate," "See My Estimate Now," or any similar submission button on the Service):

  • You represent and warrant that all information you provide is accurate, truthful, and complete
  • You grant us the right to use, share, sell, and disclose your information to third-party roofing companies and service providers so we can connect you with contractors who may provide you with a more accurate, personalized quote. You acknowledge that we may sell or share your personal information to roofing businesses and other third parties for this purpose and for their business and marketing purposes
  • You acknowledge that when we are able to find a contractor in your area, we typically share or sell your information with one or more roofing companies so they may contact you. When we cannot find a contractor who serves your area at the time of your request, we may not immediately share or sell your information to a roofing contractor; instead, we may use it to improve our service, to try to find a contractor for you later, and for advertising and optimization purposes. We may later share or sell your information to a roofing contractor if we are able to find a match for your area
  • Telephone Consumer Protection Act (TCPA) Consent: By submitting a form on our Service, you provide your prior express written consent to receive telephone calls (including prerecorded or artificial voice messages), text messages (including SMS and MMS), and emails from ZikQuote, our affiliates, and our roofing contractor partners, at the telephone number(s) and email address(es) you provide, for purposes of providing you with roofing quotes, service information, and marketing communications. These communications may be made using an automatic telephone dialing system or prerecorded voice. You understand and agree that this consent is not a condition of receiving a quote or purchasing any services, and you may revoke this consent at any time by contacting us at hello@zikquote.com. Standard message and data rates may apply
  • You acknowledge that multiple roofing companies may contact you when we share or sell your information with contractors in your area
  • You understand that we are not responsible for the services, pricing, or conduct of third-party contractors
  • You agree that we may use your information for our business purposes, including marketing, analytics, advertising optimization, and future promotional communications as described in our Privacy Policy. You may opt out of marketing communications at any time

By clicking any form submission button on the Service, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy, which governs how we collect, use, share, and sell your information.

6. Third-Party Services and Contractors

Our Service connects you with third-party roofing contractors and companies. We do not:

  • Endorse, recommend, or guarantee any third-party contractor or their services
  • Control the pricing, quality, or availability of services provided by third-party contractors
  • Have any contractual relationship with you regarding the actual roofing services
  • Accept responsibility for any agreements, transactions, or disputes between you and third-party contractors

You are solely responsible for:

  • Verifying the credentials, licenses, and insurance of any contractor you engage with
  • Negotiating terms, pricing, and contracts directly with contractors
  • Conducting due diligence before entering into any agreement with a contractor
  • Resolving any disputes directly with the contractor

We are not liable for any losses, damages, or issues arising from your interactions with or use of services provided by third-party contractors.

7. Intellectual Property Rights

The Service, including all content, features, functionality, design, text, graphics, logos, icons, images, audio clips, and software, is owned by ZikQuote or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. You may not:

  • Reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any content from the Service
  • Use any trademarks, service marks, or logos appearing on the Service without our prior written consent
  • Remove any copyright, trademark, or other proprietary notices from any content

8. Disclaimers and Limitations of Liability

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8.2 No Guarantees

We do not guarantee:

  • That the Service will be uninterrupted, secure, or error-free
  • That any defects or errors will be corrected
  • That the Service is free of viruses or other harmful components
  • That you will receive quotes or be contacted by contractors
  • The quality, pricing, or suitability of services provided by third-party contractors
  • The accuracy, completeness, or reliability of any information provided by third-party contractors

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZIKQUOTE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any conduct or content of third parties, including contractors
  • Any unauthorized access to or use of our servers or your personal information
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to defend, indemnify, and hold harmless ZikQuote, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property right, publicity, confidentiality, property, or privacy right
  • Your interaction with or use of services provided by third-party contractors
  • Any information you submit or transmit through the Service

10. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law provisions.

11.2 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Connecticut, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.

You agree to waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the Service.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ZikQuote regarding the use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and ZikQuote.

15. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

17. Acknowledgment

BY USING THE SERVICE OR CLICKING ANY FORM SUBMISSION BUTTON (SUCH AS "VIEW MY INSTANT ESTIMATE," "GET ESTIMATE," "SEE MY ESTIMATE NOW," OR SIMILAR), YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND OUR PRIVACY POLICY, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE AND CONSENT TO THE FOLLOWING:

  • YOUR PERSONAL INFORMATION MAY BE COLLECTED, USED, SHARED, AND SOLD AS DESCRIBED IN OUR PRIVACY POLICY, INCLUDING WITH ROOFING CONTRACTORS TO FULFILL YOUR QUOTE REQUEST AND, IN SOME CASES, FOR SERVICE AND ADVERTISING OPTIMIZATION WHEN WE CANNOT IMMEDIATELY MATCH YOU WITH A CONTRACTOR
  • YOU MAY RECEIVE CALLS (INCLUDING PRERECORDED OR AUTODIALED CALLS), TEXT MESSAGES, AND EMAILS FROM ZIKQUOTE AND OUR ROOFING CONTRACTOR PARTNERS AT THE CONTACT INFORMATION YOU PROVIDE
  • YOUR DATA MAY BE USED FOR FUTURE MARKETING AND PROMOTIONAL PURPOSES BY US AND OUR PARTNERS
  • CONSENT TO COMMUNICATIONS IS NOT A CONDITION OF RECEIVING A QUOTE OR PURCHASING SERVICES

IF YOU DO NOT AGREE TO THESE TERMS OR OUR PRIVACY POLICY, YOU MUST NOT USE THE SERVICE.
